Here is an Op-Ed I did on Rapanos that is circulating. This link is to the San Diego Union Tribune but the piece has also appeared in the San Francisco Chronicle and Investors Business Daily.

Victory!
We won our Supreme Court case! Yeah! But, Justice Kennedy put things in doubt by filing a separate opinion. The majority agreed with us that the agency went too far in regulating remote areas with insubstantial connections to navigable waters. This is a significant win for Rapanos personally and the rule-of-law generally. However, thanks to Kennedy, the court split 4-1-4 on the test that should be applied to determine federal jurisdiction under the Clean Water Act.
Unfortunately, after 12 years of litigation, we still don't know if the agency has a basis for citing Rapanos for clearing his land without a permit.
Read the 100 page opinion here.

The Nashville Hoppers Come To Visit
Alan and Kristina came by for Father's Day and to see old friends. It was great to have them here. We hadn't seen them for several months. We look forward to the family reunion next week when we can spend more time togther.
Here is Amara trying out her new bench. She was even willing to share with her startled brother. Ethan is learning long division with the Abacaus with Aunt Anna as tutor.

Dick & Janet
Well, Dick and Janet finally made the move. Yesterday was their last day in Fresno, to which they say ..."Good riddance!" Friday they said adieu to their employers. Then, on Saturday, they packed their bags, a moving van, and a U-haul trailer and made their way to the quaint town of Davis where they spent the afternoon and evening with good food, great conversation, and unsurpassed company. They also brought Casey who seemed to take an unusual interest in Eowyn.
Here are a few pics I was able to snap juste before the battery on the camera died.
